With Mike Pesca in for Tom Ashbrook

Are members of Congress using inside info to get rich? We’ll talk dirty politics and big money with a panel including former super-lobbyist Jack Abramoff.

It started with a basic question, as so many good investigations do. How is it that so many members of congress come into office as solidly middle class and leave quite rich. The answer, as Peter Schwiezer discovered was the rules don’t apply to them.

What Wall Street would call insider trading is legal for Senators and Congressmen, who are often in the position to be the ultimate insiders. Lobbyists like Jack Abramoff add another dimension of dirtiness, just ask him. Gore Vidal called Bribery our form of democracy, here’s the documentation.

Jack Abramoff, former lobbyist and author of Capitol Punishment: The Hard Truth about Washington Corruption From America’s Most Notorious Lobbyist.

Highlights

Congress is using non-public information to make stock trades and enrich themselves, contends author Peter Schweizer, in a new book detailing what he describes as rampant insider trading on Capitol Hill.

“During the debate over the Obama healthcare bill there were people on both sides of the aisle that were trading healthcare stocks that, if they were anyone else in America, the timing of their trades would have led the Securities and Exchange Commission to be suspicious,” he said. “For members of Congress, this is considered common practice.”

Compounding that problem is the “revolving door,” where Congressional staff leave for lucrative jobs in the private sector and often trade on their access to politicians that they previously worked for.

“What I would do was to offer a job to a staffer on the Hill…and the second that that job is offered, even if the jobs is a few years down the line, from that minute on, [the staffer] is owned by that lobbying firm,” said Jack Abramoff, the formerly jailed lobbyist. “Their loyalties switch and that is utter corruption.”

It is an open secret in Washington, Abramoff said, that politicians were trading on inside information. “It’s almost worse than insider trading, where companies trade on information that’s not yet public,” he said. “People on the Hill have information that companies themselves don’t even have yet.”

Unfortunately, Ambramoff conceded, reform efforts pushed through Congress rarely reform. “It’s actually worse than that: lobbyists look for these reform bills, gleeful, because they know that the people who are pushing these reforms really get too serious because they (a) want become lobbyists when they leave, and (b) benefit from the system while they’re in there. So, there’s nothing that they’re going to put forward to put a crimp in the lobbying world,” he said.

“Think of reform bills as moving trains that are going to pass, moving past the House and Senate and getting signed by the president. So clever lobbyists look to try to put onto those trains garbage that has nothing to do with reform. I myself tried to do it to the Help America Vote Act, where I tried to put a measure to get a casino legalized in Texas.”

“The worst thing it does is enables them [Congress] to go around patting themselves on the back and to tell everybody to go back to sleep, the problem is solved,” Abramoff said. “The problem is not solved.”

From The Reading List

60 Minutes “Washington, D.C. is a town that runs on inside information – but should our elected officials be able to use that information to pad their own pockets? As Steve Kroft reports, members of Congress and their aides have regular access to powerful political intelligence, and many have made well-timed stock market trades in the very industries they regulate. For now, the practice is perfectly legal, but some say it’s time for the law to change.”

The Daily Beast “Schweizer, who is 47, lives in Tallahassee with his wife and children (“New York or D.C. would be too distracting—I’d never get any writing done”) and commutes regularly to Stanford, where he is the William J. Casey research fellow at the Hoover Institution. ”

CBS News “Jack Abramoff, the notorious former lobbyist at the center of Washington’s biggest corruption scandal in decades, spent more than three years in prison for his crimes. Now a free man, he reveals how he was able to influence politicians and their staffers through generous gifts and job offers. He tells Lesley Stahl the reforms instituted in the wake of his scandal have had little effect.”

    mozilla is also fighting this.

On November 16th, Congress holds hearings on the first
American Internet censorship system. This bill can pass. If it does,
the Internet and free speech will never be the same

    Why?

A few infringing links are enough to justify censoring an entire site, blocking good content along with the bad.

    How?

The US will be able to block a site’s web traffic, ad traffic
and search traffic using the same website censorship methods used by
    China, Iran and Syria.

    Who’s at risk?

Your favorite websites both inside and outside the US could be blocked based on an infringement claim.

    Could this pass?
Yes. The Stop Online Piracy Act and the PROTECT IP Act have widespread support in Congress and are expected to pass.

Kerry’s revolving door connections include big guns on K Street

    http://www.legistorm.com/

Sen. John Kerry (D-Mass.) is well acquainted with the revolving door.
    With
88 revolving door connections, Kerry has hired more people who have
also lobbied than any other super committee member. Kerry’s connections
come both from his congressional office and campaigns – including his
sprawling presidential campaign. On Capitol Hill, 36 revolving door
staffers have worked in his personal office, and another nine have
worked under him on Senate committees. His campaign staffers add another
    43 revolving door links.
Kerry is one of three Democratic
Senators on the Joint Select Committee on Deficit Reduction, or “super

Clyburn’s revolving door swings onto the Podesta Group

Posted by LegiStorm on Tuesday, November 01, 2011

The revolving door from Rep. Jim Clyburn (D-S.C.) opens directly on the Podesta Group, a prominent lobbying firm.
Of the 11 revolving door connections LegiStorm has found for Clyburn, four have worked for Podesta either before or after their time on Clyburn’s staff.
    Clyburn
is one of the House Democrats on the Joint Committee for Joint Select
Committee on Deficit Reduction, or “super committee.” LegiStorm is near
the conclusion of a three-week series highlighting the revolving door
connection of all the super committee members.

Kyl’s top staff spot is magnet for the revolving door

Posted by LegiStorm on Thursday, October 27, 2011

The revolving door has been spinning actively for Sen. Jon Kyl’s
(R-Ariz.) chief of staff position, including a move this week when Kyl
brought on a top lobbyist for that role.
    Kyl has had three
chiefs of staff in his Republican Whip’s office since the start of 2009,
all of whom have been through the revolving door. They are only several
of Kyl’s 45 revolving door staff connections LegiStorm has identified,
29 of whom worked in his personal office. Kyl, who has announced he
will retire at the end of his current term, is one of three Republican
senators on the Joint Select Committee on Deficit Reduction, or “super
committee.” LegiStorm is profiling the revolving door ties for all of
the super committee members in a three-week series.
It was reported this week that Kyl had hired Dave Hoppe
to be his new chief of staff in the Whip’s office. Hoppe last worked on
the Hill as chief of staff to Majority Leader Trent Lott, and has spent
the last eight years as president of the lobbying firm Quinn Gillespie
and Associates. The previous chief of staff, Lisa Wolski, moved to GE. She is a former lobbyist for the Retail Industry Leaders Association.

    The takeover

    By Charles Peters

    http://www.washingtonmonthly.com/magazine/november_december_2011/tilting_at_windmills/the_takeover033012.php?page=all&print=true

“In previous columns I have noted that
congressional staffers now dream not of becoming members, as they once
did, but of earning big bucks as lobbyists. Now comes a study with the
hard evidence, produced by the transparency advocacy group LegiStorm,
finding that almost 5,400 current and former staffers “have gone through
the lobbying ‘revolving door’ in the past decade alone.”

Lobbying firms also have reverse influence by farming out their
employees to serve as staff on influential congressional committees. For
example, the Washington Post has reported that there are
thirteen former lobbyists on the tax-writing House Ways and Means
Committee and twelve serving as staff for the debt reduction “super
committee.” To top it all off, the Project on Government Oversight
reports that a former Goldman Sachs official is now employed by the
House Committee on Oversight and Government Reform, “helping the
committee chair, Rep. Darryl Issa (R-California), write letters to
banking regulators questioning the need for new derivatives oversight.”

    Seems America is Fkd,

As I watched 60 minutes another piece to this story that came to my mind.  Are the Wall Street insiders watching the accounts of the Washington insiders and using that information to make inside trades?
I want my next Congressman to take a pledge not to take any money other than their 174,000 salary given to them by the Federal Government.  I don’t want them to trade any stock during their tenure in office, or to raise any money, or take money from a PAC while in office. I don’t want my congressman to donate money to anybody else’s campaign either.  I want a citizen politician who serves the best interest of the country, not one that trades favors to get rich.  The vast amount of money in politics has to change, any idea that a congressman can think independently when so much money is involved is ridiculous.

    • Anonymous

That 60 minutes show was a hatchet job. I’m not a fan of Boehner or Pelosi but they left out a lot of facts on that show.

Interesting link, but I read it as whitewash spin by a congressional cheerleader.

Reminds me of Bush 2 supporting immigration reform….an easy, no cost political posture on an issue that his party would never allow.

Or throwing out Alaska Senator Stevens conviction on the impropriety of the [republican] federal prosecutors.

Pardon my cynicism, but as in Casa Blanca: ‘I’m SHOCKED there is gambling going on!’

They can pass plenty in the House knowing it won’t get though the Senate (or vice versa), and when it doesn’t the affected stock soars. Or, the stock goes up because guess what?….the bill has no teeth! When it comes to big easy money, these people are thick as thieves.

They’re not doing the stock picking mostly anyways, they have professionals managing the use of inside info in buy-sell decisions. That would be the interesting part: who is actually making THOSE decisions?…Pelosi’s husband?…their broker?…how far does the exemption apply?….congressmen, their 10,000 staffers, with families and brokers?

Either way, exemption from insider trading laws for these folks is a BAD idea! They can always use a blind trust….or follow the law like us grubs!

        • Anonymous

That’s not how I read it. In Boehner case he did not tell his broker to buy those stocks as they were part of a portfolio of blue chips he was investing in. There are worse cases of conflict of interest than what 60 minutes was showing with these two. I think Pelosi is the better case of the two due to her husband. In my view most of these folks are gaming the system as they are on the inside of the beltway.
When Nixon was president none of the ways that money is raised now was even legal. There were something like 200 or so lobbyist in Washington. Our government has been taken over by special interest that is clearly evident. My objection however, to the 60 minutes piece was that it was not well researched. Also I just can’t take that show seriously as a news show anymore.

I heard this journalist, Tim Dickinson, speak yesterday on Fresh Air on one aspect of this subject.
It’s definitely worth the read as the thesis is that the old Republican party has lost out to the supply side aka, Grover Norquist “no taxes” Republicans.

The story linked above by Grim seems more like a spin job or damage control in reply to the 60 Minutes segment.

“Despite a stubbornly sour national economy congressional members’ personal wealth collectively increased by more than 16 percent between 2008 and 2009, according to a new study by the Center for Responsive Politics of federal financial disclosures released earlier this year…

The most popular investment among congressional members reads as a who’s who list of the most powerful corporate political forces in Washington, D.C. — companies that each spend millions, if not tens of millions of dollars each year lobbying federal officials. Many of them likewise donate millions of dollars to federal candidates each election cycle through their top employees and political action committees.”

    To:
            Congressmen/women and anyone listening

    In
view of the multitude of challenges facing our nation and its’ population
today, I would like to propose a single solution that I believe would be one of
the most workable and effective single steps that could be taken:

    As
lobby money provided by commercial interests (industry, trade associations,
corporations, non-profits, etc) influences policy, regulation, tax code, and
legislation in such a one-sided manner, without comparable counter-influence
from a public interest group, I would propose:

Require all lobby expenditures to be split
50/50 between the current lobbying groups, and public interest lobbying groups.

    This
has several advantages: 1) simple to implement; 2) at minimal cost to
government; 3) intrinsically transparent; 4) job creation (doubling the number
of lobbyist jobs); 5) most importantly, it will deepen the arguments and
understanding of any given position as lobbyists solicit government
    intervention in existing policy.

    I
    believe lobbyists can perform a valuable service in educating policymakers;
however, the weakening of the middle class over the past 30 years is evidence
enough that commercial/institutional interests employing lobbyists have been
waging one-sided arguments leaving the public short and shut out. The Occupy
    Movements are further evidence.

    I
understand the near impossibility of implementing positive change in a system
structure whose dominant object is to preserve itself, ie maintain the status
quo, but I am floating this idea as far and wide as I can in the hope a “great
oak may arise from the acorn.”

I understand this proposal is not a “single bullet” solution, and much more is
required to reverse destructive social trends; but I believe this could be a most
    effective/workable single effort.

    • Flowen

Sorry for the weird spacing…copy and paste and no editability.

    • FlowenInTheWind

Instead of removing the objectionable money from the system, you want the private interests to pony up half of their allotted expenditures to be spent on some qualified public interests?

Who is to decide what public interests are of consequence and served by half of the private monies – does it go into some general pool to be dipped from by any one needing connections?

In essence, your ‘solution’ still remains a ‘pay to play’ system with the relational influence and control to match – possibly with only more being able to participate in the game.

Appreciate your idea and an attempt at a solution, but it seems wholly ridiculous.

      • Flowen

        I like your name!

Your suggestion that money can be gotten out and kept out of the system of influence is plainly not happening nor will happen!

Lobbyists can and do provide a valuable research/education function…but they’re deeply one-sided and are not operating in the interests of the public. How do you fix it?…by trying something that makes sense.

The alternative is continuing breakdown, cause that is the trend!…nothing happening to change it.

  • Brian

This makes me sick to my stomach. The systematic conflict of interest here is atrocious… no wonder they’re all corrupt.

Here’s a quote from the cbsnews article.

    “A report released
earlier this year by four universities found that on average, stock
portfolios held by House members from 1985 to 2001 beat the market
average by approximately 6 percent annually. In 2004, the same group of
professors found that the average stock portfolios held by members of
the Senate beat the market average by about 10 percent.”

    • Jasoturner

It should make us sick.  The founders created a unique and wonderful philosophy and structure of representative government.  Our current crop of politicians have fully perverted and ruined it in their piggish pursuit of personal power and riches.  They have basically aborted the greatest democracy the world had ever seen.

What pledge would you like to see your next house of Representative sign?

I, _______________, pledge to the taxpayers of the _____ district

ONE, oppose any and all efforts to increase the marginal income tax rates for individuals and/or businesses; and
TWO, oppose any net reduction or elimination of deductions and    credits, unless matched dollar for dollar by further reducing tax rates.

I challenge today’s comment posters to write a clear concise pledge that represents the 99 percent left out by Norquist’s pledge.

I am a Professor in a major MBA program and called in several months ago to Tom Ashbrook and Greg Zuckerman of the Wall Street Journal. I worked on Wall Street for many years particularly in the Mergers & Acquisitions business and am a former in-house Regulatory Supervisor.

    The
so-called academic work that “proved” that our Representatives could not be
insider trading (or were only receiving a small premium return and therefore had some advantage) was wrought with serious flaws in the underlying data (it did
not include the trading accounts where the highest returns were received such as
hedge fund investments, options accounts and real estate partnerships), its
analysis (at best incomplete) and its interpretation (it was not a
representative nor accurate sample and therefore could not support the
conclusions that were reached much less the sweeping statements about honest
behavior being made by the Representatives nor by the media including the Wall
    Steet Journal).

This was not necessarily the fault of the academics who did the
study as they were kept from the complete data…. but they received some
“personal benefits” (grants, fees, recognition, etc) as a result of the study’s findings and publication… and
are therefore part of the problem.

it is difficult to estimate what our Representatives are making on the “investment” of becoming an elected official. Rarely does anyone, elected or Congressional staff, leave DC with anything less in their bank accounts than they came with. I believe that a reasonable estimate is many millions per elected member of Congress, and those financial benefits of insider information are shared with their friends, family and “inner circle supporters” both back  home and in their political parties.

  • Jasoturner

Is this a parody?  Why would most Congressmen kill their own mothers to keep the job?  Of course it’s a ticket to wealth and power.  Connections, not competence, is the key to game.  This just seems so self evident that I am surprised it can even be discussed for an hour with straight faces.

  • http://www.facebook.com/profile.php?id=1107157095 Henry Cave Devine

We are about to see one of the most extensive and worst cover-ups in the history of America by our members of Congress. They will burden us with committees and reports and will try to let other news (e.g. Afghanistan, Iran, the economy, the elections) obscure the truth.

This is Watergate 1,000 fold over, and the cover-ups will be massive. The trading and other accounts were well-hidden in the first place but document shreading, email/file deletion and server/storage “changes” will be rampant in DC and at the banks/brokers and hedge funds who have carried out the trading for our Representatives and staffs.

  • Psummers96

Future: Penn State is acting like universities across this country in failing to “find records” of Mike McQueary’s actions when he witnessed the abuse. Pro Publica in 2010 investigated the reporting and handling of campus crime … I urge you to read it. Administrators close ranks and records simply “disappear”. My Public Affairs joined in the search on our own campus and found that not only did records of reported rapes disappear, but they were not reported to the department of education as required to qualify for federal funding (including student loan money for students.)  The two incidents were covered by the student newspaper, but no records were available from campus police… that is until we contacted the office of the attorney general with an open records request.

What McQueary saw and did, in my opinion, is likely just as he said. As a graduate student (or even a faculty member as in some cases) the good old boys (and girls) network on college campuses is too strong to fight, and many simply give up. I can only imagine what students learn when such behavior is the norm (and it is) among those with power. … and we wonder why the ethic in the public and private spheres is so low.

Please address this issue …. the practice is very common and most are powerless to halt it.

In what way does this have to do with corruption in DC.

  • Rob (in NY)

Mike,   I work in the management consulting world where I advise companies on M&A transactions. As a result of my career, I often have knowledge of M&A transactions before the general public so the application of insider trading laws to people such as myself is quite simple and non controversial. It is illegal (as it should be) for to me to act on non-public information not avaiable to the general public.  I actually go a step further and choose not to own stock in my clients to avoid the appearance of unethical behavior.

In theory, I support applying the same insider trading laws to members of Congress and their staff (as most insider trading laws do not currently apply to them). However, in practice this is far more complex because the information Congress is often dealing with relates to more generic economic and industry data  (rather than specific companies) and  Congress has regulatory jurisdiction over every publicly traded company in the US.    Would this mean that a member of Congress who serves on the Banking Comittee could not own any bank stocks?  Or a member of the Financial Services committee could not own any stocks (as they have jurisdiction over the the SEC which oversees all public companies)?

I also found some of the data used in the 60 minutes piece misleading.

    • Anonymous

Maybe they should not be allowed to trade while they are serving in Congress. It seems to me the other problem is that they are also making laws that have direct affect on their own wealth. For instance the tax on capital gains which is at historical low. The Republican party wants to do away with this ta altogether.

As I said, the 60 Minutes piece was skewed and had a lot of faults.
      It was just bad journalism.

How about doing away with the House of Prostitution where every congressmen needs to grovel before 1% of corporate and wealthy interests for donations in order to be re-elected?

How about forbidding both Unions and Corporations (and the numerous micro-loopholes they’ll pour through) from a. lobbying and b. giving money.

This would necessitate publicly-funded elections – with attendant howls of protest from those who understand how they benefit from the status  quo. But if we want our country back, this would be a good place to start.

Questions for the show this morning:

Who has the authority outside of our self-serving Congress to do something about this serious problem? Could the SEC initiate action and not have their funding cut off by Congress for doing their job? Do the individual states have corruption or other laws that would cover these crimes? How will these ill-gotten gains be taken away from the Representatives, their staffs and the others who have shared in the insider information?

    • Leatherstocking

Voters.  Vote every single person out. Repeat as necessary. Support unconventional candidates who at least challenge the status quo.

Our fear and inability to follow through on our threats to shake up the system by voting for a Nader, Perot, or Paul, are just really cementing the loss of our democracy and the rise of the plutocratic technocracy.

      • Mark

I often wonder if “throwing the bums out” is the best solution.  Shortening terms to 2 or 4 years means institutional memory, hard-won experience and learning goes with them.

Perhaps it would be better if we, as constituents, paid close attention to every thing they voted for, quizzed and questioned their every move, speech and policy.  This would require a drastic change from the vote, forget and complain notion of citizenship practiced by most Americans.

Above all “We the People” need to insist Congress change the structure of government – right now, it’s utterly broken.

        • Leatherstocking

Exactly.  We have been lemmings for decades, and are reaping the “self-government” we have sown.

Many here seem to accept that and are ready to call in the technocratic elite politburo of better, smarter people to run the show for us….  Wait, hasn’t that been happening for some time now? Why didn’t it work?

Yes, it takes effort and commitment.

Meanwhile name and shame the K-streeters.

          Sunshine.

This doesn’t require party affiliation, or some elaborate, corruptible government solution.  Just a motivated electorate that wants to get back to basics.

          • TFRX

Give it up, Dave, we all know it’s you.

And a motivated electorate? News flash: You can’t fix government without “some elaborate, corruptible government solution”. And you can’t fix it without admitting that a third of our mainstream press is nothing but propaganda, and another half are piss-pants scared of being called “liberal”, who can’t file any story without looking at Drudge (legitimized through Fox, and Politico) first.

How about a shout-out to all the OWS folks who want to break bread with the racists, misogynistic, xenophobic, gay-panicking, education-hating Teabaggers? Have we had one today?

Why not dump the partisan self-righteousness and figure out how we stop it all, for the benefit of the whole country?

We already know both parties stink.

You can choose a big government, micormanaging elite, central rule, crony-state capitalism party….

or the old fashioned crony capitalism and protecting the wealthy/powerful party that removes the Rule of Law part of our Liberty + Rule of Law equation party.

        Great choices.

        • TFRX

“Partisan self righteousness”? Pfft. I’m from the Democratic wing of the Democratic party, and I’m looking to talk with Eisenhower-style Republicans.

(Note to self: Explain to my college-ages relatives what an Eisenhower Republican used to be before they went extinct.)

At some point there’s nothing I can say to a Libertarian to make them look worse. Love the false equivalence. Love how you’re doing what Roger Ailes would pay you to do.

          • Leatherstocking

The disturbing thing is you are so much more interested in character bashing and blanket dismissals than in finding common ground.

Why don’t you spend 1/5 of the time demonstrating that you understand the rationale and historical, empirical context of a point, and then explain why you disagree, and then provide a counterpoint with rationale and empirical support.

Define what you want us to understand about your vision as a Democratic Democrat and Eisenhower Republicans, if you can stoop to the level of the ignorant pajama masses.

What comes across is more the idea that you would like to round up an eliminate the pajama masses because their idiocy is standing in the way of your nirvanna.

The difference between a more libertarian view and that, is a respect for diversity, and a humility to “live and let live” when we disagree with the views of others and even regret the lost efficiencies of such diversity.

Todays show a great example. You would rather argue about false equivalence, than talk about how to stop both parties.  Even if you are right and its 79% an R problem and 21% D, if you do the systemic, even handed thing, you will still solve the R problem.

The partisanship and arrogant superior attitude of better knowing Democrats over stupid, simple minded Republicans, which I have participated in in the past, is not going to cut it.

While the vast majority bickers, the elite who could give 2 $hits about party affiliations, apart from the divide and conquer role, continue to evade the rule of law, and rig the system.

          • Plushkin

I want to “round up and eliminate” certain media? I’m bashing (unfairly assailing) character of people? Har de frakking har. You are so scared or frustrated that you can’t think straight.

And “what comes across” to a ivory tower Libertarian is so not equal to what comes across to ordinary people with whom I talk politics. Maybe, just maybe, the attitude you get from people is related to your disconnect from the real world.

Go back to telling post-bachelor-educated Connecticut suburbanites how the ignorant, xenophobic, misogynistic, racist, gay-hating Teabaggers (and the propaganda media without whom they’d be nowhere) should join forces with Occupy Wall Street.

Would have been nice to get Bill Black in on the panel and keep the accountability/rule of law heat on.

Let see how our status quo, establishment Democratic and Republican party supporting State-Capitalists and Discretionary, Revolving door, Technocratic rule defenders spin this one today.

We don’t have a clear, simple, transparent and rigorously enforced, level-playing field rule of law.  And we have handed over so much discretionary, unaccountable power to Fed Bankers, Washington technocrats, advisors and appointees to executive departments, that there really is NO rule of law anymore, and small group of perhaps well meaning, but certainly corruptible, “elite” people are just micromanaging us by the seat of their pants, in a nearly tyrannical way.

We don’t need more tailor-made, loop-hole ridden, case by case, overcomplicated rule making to give the appearance of accountability. We need a transparent, evenly applied and aggressively enforced
    set of guidelines.

They will always hide behind the complexity if we let it stand.

That one side sees the Koch brother as these shadowy figures behind so many of these nefarious dealings is as myopic as the other who sees George Soros behind so much. There are much more obvious crooks on both sides who keep themselves in office, by making sure you think the other side is evil incarnate.

I’m sorry I don’t have the exact details, but I heard that a republican congressman bought land, then pushed through an earmark that created a road then went right through his land and made millions (a few I think). Again, I’m sketchy on the exact details, but of one pile of $20B that Obama spent on solar initiatives, $16B went to companies that had people on his reelection committees either in senior management positions (like the CEO), or on the boards, or were people who aggregated money for his reelection.

My guess this corruption is massive on both sides and pretty obvious. And the introduction of these shadowy figures manipulating things in the background is a distraction.

So this is one of the ways corrupt politicians get rich.

The CORRUPT WEALTHY ELITE make their millions or billions in this same way every day of the week!!!!!!

But let’s protect all these dirtbags and make sure they get plenty of TAX CUTS, RIGHT REPUBLICANS?!!!!!!!

  • Robert Dente

    Who will guard the guards?

It’s becoming starkly obvious that America is heading the way of Greece and Italy, whereby the populace, having lost their faith and trust in self-serving government, no longer participate in democracy because the corruption has already mortally wounded the economic future of their countries.

    • Leatherstocking

It doesn’t help that we are consumeristic, materialistic, instant gratification, and sense of entitlement to former, pigs.

So do we slap ourselves awake? Or just look for the benevolent dictator?

      • Robert Dente

Both in a way—we need a Teddy Roosevelt and a more aware citizenry.

  • Anonymous

Getting rich from your government connections is not limited to Congress or their staffers.  In truth, their take pales in comparison to the real money made by defense contractors, road builders, etc., not to mention the billions many are able to keep by paying a lower tax rate than someone making $30,000/year because of their ability to influence the federal legislative process.  As some wit once said, “if you ain’t cheatin’, you ain’t tryin’.”

  • Tjlark

Don’t forget to mention John Kerry and his wife’s trades…..

  • Anonymous

We get it.  Lawmakers can get away with insider trading, but what can you do when the lawmakers make the law an when both parties are in cahoots?  We need to make some fundamental changes to the structure of our governmental body, making a new law won’t do because they are made by law makers.

Law makers can threaten budgetary cuts if they don’t like the FBI or the SEC investigating them.  We can at least separate lawmakers from making budgetary decisions.  I really do think national level participatory budgeting should be part of the fundamental reforms.

    • Leatherstocking

      We elect lawmakers.

50% of Americans can not name a Republican candidate.

While that’s music to Dem ears of course, it shows the sorry state of our self-governance.

Do we work to change that and revitalize our system, or just go for the Benevolent Dictator, like some Dems seem to want to be.  Which is great as long as they are benevolent. History shows that never lasts.

Email I have sent to Senators Kerry and Brown and Rep. Lynch:

    Dear [Senator Kerry]:

I have never written to a Congressional representative before so I apologize in advance for anything that appears too harsh or opinionated.
The Congressional insider trading scandal is on the verge of turning into one of the worst moments in American political history. Having spent many years on Wall Street and in M&A, I know the rules and have known since 1980 or so the exclusions that protect the Congress. I am also familiar with some of what has gone on and the string of events/actions that may have occurred in the investment activities of the Representatives, their staffs, friends and family where insider trading might be protected for the Representative but not for the other participant/offenders.
I have no idea what your or your staff’s involvement might have been, and those possibilities are not foremost on my mind. We need good honest tough leadership in this matter. Please step forward and pursue all of the offenders and change the rules that have protected these and other forms of unethical behavior by our Representatives and certain related parties.

    With respect,

  • Leatherstocking

This is an issue at all levels of politics.  Politicians see it as a way of making up for the “lower-than-private-sector” wages they earn.

  • Scott B, Jamestown NY

Isn’t the simple answer (and contrary to Mitt Romney’s statement to Cain’s “999″ plan) to make the members of Congress, and every other government employee, obey the same rules as every other American citizen?

Well that would be true if I was a democrat, alas I’m not.
It seems to me that the GOP has been in drivers seat with deregulation and creating a pretty good environment for this kind of crap to happen. Even Abramoff is admitting to this. 60% were republicans and about 30 to 40% were democrats. Himmmmm…I’m not playing any blame game. I don’t hide my complete contempt for the republican party, I find it has become this extremist party that does not represent anything I believe in.

fair enough. 30-40% is bad enough and shows systemic breakdown.

I have often thought this would have to be part of the solution.  That and making lobbying an information only business, elections publicly supported, and give federal regulatory agencies absolute isolation from corporations.  No corporate reps former, present or may ever be associated with an industry for which the agency provided regulation.

  • Anonymous

The only solution are laws that remove Congress members and ex Congress member permanently from the private sector. They have a comfortable pension – they won’t get rich, but that’s not suppose to be the reason they seeked getting elected.

If they want to stay active in the private sector, they can stay out of the public sector. Simple

  • Disgusted

It’s amusing to hear the donors and contributors to this show/BUR/NPR . . . the very people and groups that are part of the problem . . .

  • Markus

That’s a big issue they mentioned. Would you John Kerry supporters vote for his opponent, a republican, if you knew he was part of this appearance of inside trading. My guess is not. Same for Scott Brown supporters if he gets connected to this.

We all hate this, but when it comes to our rep, we’ll make excuses for them if the alternative is the other party. Our convictions are pretty limited.

    • TFRX

It’s not even party-related, as far as I’m concerned. People’s alarm setting for corruption in politics is much lower outside their own district or state.

  • Noah

Lets talk about solutions.  Preventing lawmakers from making these unethical trades is a negative economic incentive.  Obviously economics is a powerful motivator.  How could we provide a very positive economic incentive for our lawmakers to do the best they could for their country?   Is it possible to pay them enough that bribery and insider trading isn’t attractive, or is that simply naive?

    • Drew You Too

       Simply Naive.

    • Anonymous

Maybe we should be seeking representatives that are not only working their own personal gain? There are many, many workers out there that are not in it just for the money.

    • Christine Gallo

If that were possible then it would be possible for some of Wall Street’s biggest earners to have satiated their appetites, and that doesn’t seem to have occurred. Positive reinforcement works when we are training small children, but by the time you get into Congress supposedly you have developed a sense of morals.

    • Anonymous

No, that is not possible.  Enough is ever enough for the “ambitious” type that would trade on their public trust for cash in pocket.  If it isn’t made illegal, at least institutionalize the process of making it public so voters can get an idea of what their rep is up to.

Let’s start with the notion that people aren’t bad, or our elected officials are intrinsically evil, but the structure they work in is broken.

We all need to insist that they who represent us start changing the rules (or lack thereof) in which they operate and govern themselves.

By insist – I don’t mean throwing them out in the next election, but by bearing down on them – paying close attention, and calling them out when they stray from serving OUR needs and interests FIRST.

It’s a huge challenge, but until we become [effectively] vigilant we get the government we deserve.

“Start with the notion people aren’t bad…”?

        You’re wrong.  DC is cesspool.

Vigilance won’t help now, the cancer is too endemic to the system.

Throw them all out.  They had their chance, they are part of the disease process.

Changes won’t be made until newly elected officials start making them.

And if they don’t do it, then throw them out too.

Eventually, reforms will lessen corporate power and they will lose their grip and influence on the system and our government will evolve and start serving the people.

But, make no mistake, you have to throw the carpetbaggers out.

In some ways this is a catch 22. The only people who can make the laws in the regards to this corruption and insider trading are the very ones who write the laws. I think the only way forward is a national strike and shut the whole thing down. If the Tea party folks are into it more the better.
    Enough is enough already.

    An interjection:

What have we come to America?

We have indulged too far too long in the language of malice, mistrust and negativity. We put those who want to be of service in a very difficult position, to say the least.

Many wonder why people run for public office in America today. Just think about it:

A candidate will spend an enormous amount of energy, time and money; disrupt one’s personal life; open one’s self to personal attacks; campaign long hours to get elected to what?  — a job that pays a measly sum (or none at all) and require laborious effort that hardly satisfies anyone.

Running for public office has been called the toughest job interview. The applicant is subjected to innumerable gridiron situations – where one’s intentions and abilities are constantly and unrelentingly questioned– often dragged to low-level smear tactics by political opponents.

From what one gathers in today’s media, where there is no shortage of pundits, commentators, analysts and critics, it seems that no amount of credentials is good enough — even with those who aspire for the highest offices in the land.

There is widespread skepticism among the voters. We all know, of course, what happens to those who actually assume office. The attitude has turned irreverent, to say the least.

Now, that’s a lot to pay for some recognition and for a genuine desire to contribute something to one’s community.

For their sheer gumption to push through with their desire to serve, we owe these brave men and women the benefit of the doubt.

i think that we have stretched our socalled “freedom” too long too far- there is an inordinate sense of entitlement here in America today-

As a lifelong community organizer i have always espoused positive, proactive and peaceful ways-  not the incendiary language that many use today-

in fact, i often question the so-called rule of law which in reality has spurred what is really an oligarchy rather than a real democracy. when people sue or get sued- those who have the wherewithal to hire the expensive lawyers will always have the edge-

i am an advocate of real grassroots power- that is why here in Santa Barbara in my Mesa neighborhood, i endeavor to be  to organize by families and by street.

Next to your family is the street neighbor-  street watch and emergency preparedness hinges on how well you know your next door neighbors
(no matter how difficult and undesirable they are!Let’s make an effort)

When you know them, you will have a better understanding of each other and you can better talk to each other- negotiate. I always remind neighbors -no suing on the Mesa! Let’s talk it over-  this is why we have our regular monthly village hall meetings to iron out issues and to learn new things to make our community better. We have resolved many issues this way.

What i learned early on about freedom is-  for every right is a corresponding responsibility-

This means –if we have the right to point out, we have the full responsibility to bring into the table creative solutions-
otherwise, it is simply whining from our paltry corner.

One of the speakers mentioned that the “new law should prohibit trading in any companies related to their congressional committees”.  What make us believe that Congress will not form little groups so that the Congress person on the Banking Committee will not tell one of their colleagues on the Energy Committee about pending legislation. Perhaps they should be prohibited from all trading, except large mutual funds.  They may even find a way around that restriction.

They need to live by all the rules that the rest of us live by.

Forgive the paraphrase, but we get the leaders that we deserve, cast in the die of that which we value.  To my mind the question is not which party we are beholden to but rather how much we are personally willing to identify the problem and then how much we are personally willing invest to change the status quo.

More fallout from downfall of Corzine’s criminal enterprise:

Here’s Gerald Celente who’s always great:

    http://www.youtube.com/watch?v=W02n-wjPqNE

And today, this from Barnhardt Capital Management (RIP):

It is with regret and unflinching moral certainty that I announce that Barnhardt Capital Management has ceased operations. After six years of operating as an independent introducing brokerage, and eight years of employment as a broker before that, I found myself, this morning, for the first time since I was 20 years old, watching the futures and options markets open not as a participant, but as a mere spectator.

The reason for my decision to pull the plug was excruciatingly simple: I could no longer tell my clients that their monies and positions were safe in the futures and options markets – because they are not. And this goes not just for my clients, but for every futures and options account in the United States. The entire system has been utterly destroyed by the MF Global collapse. Given this sad reality, I could not in good conscience take one more step as a commodity broker, soliciting trades that I knew were unsafe or holding funds that I knew to be in jeopardy.

Everything changed just a few short weeks ago. A firm, led by a crony
of the Obama regime, stole all of the non-margined cash held by
customers of his firm. Let’s not sugar-coat this or make this crime
seem “complex” and “abstract” by drowning ourselves in six-dollar words
and uber-technical jargon. Jon Corzine STOLE the customer cash at MF
Global. Knowing Jon Corzine, and knowing the abject lawlessness and
contempt for humanity of the Marxist Obama regime and its cronies, this
    is not really a surprise…

Thanks “twenty-niner”, nothing like seeing the facts right in front of our eyes. Exactly. WHERE are these people? You know, the ones with the money? Gone. Vanished into thin air while we sit here blogging about how, ‘Criminal’ it all is. They know they will get away with it. No one is watching the MONEY. It’s like anyone can walk into a vault, stuff their pockets and leave, and no one says a word! Not congress. Not the President. None of the ‘Candidates’. The Money is disappearing left and right, and there are no police. At the White House there’s NO ONE HOME. In the Congress, there’s NO ONE HOME. We’re on our own people. THANK YOU! For shining even more light on this issue. So many people are in denial with the fact that this country no longer is a Democracy. No politician is working for WE THE PEOPLE. They work for themselves. The two Party process is merely to funnel a handful of Corporate sponsored candidates, up to Presidency level so he or she can hand out the money. It doesn’t matter what PARTY the President is from. He/She is BOUGHT by the corporations. Their job is to pat us on the head, calm us down so Wall street won’t crash, and give money to their friends, and use BAILOUTS as a revolving door to give themselves a CUT of the money, transferred digitally to their offshore bank accounts. SCREW the people. The entire system has to come down. We need to eliminate the Repug/Demo system and vote directly. City by city, state by state. Vote direct, eliminate campaign money and lobbyists. Thank You, ON POINT!

The question is do you blame our Constitutional Government system and Market Capitalism, or do you blame our lack of vigilance in our role in SELF-GOVERNMENT.

If we haven’t already, we are, in our ignorance, laziness, and cowardice, going to hand over the American experiment in Self-government and liberty within a Rule of Law system, for centralized, technocratic, State Corporatist rule.

American, Liberty Capitalism or China Authoritarian Capitalism?

Only the fringe still holds out for Communism, but I really fear the Authoritarian Capitalism defenders, or acceptors by default.

      http://www.montpelerin.org

Before we throw in the towel, in this internet age, can we at least try to take back our representative government and demand accountability and the rule of law as our core, before we agitate for some other failed radical notions?

Don’t you guys think Accountability and Rule of Law to all would be quite different from what we have today?  If the Tea Party types could accept that, and the rest could accept that, why not try that first, trusting regular Americans and their collective individual choices, motivation and integrity to move us forward.

An actionable majority is never going to agree on some highly theoretical or centrally managed, China-style society, unless you plan on gassing half the people.

      • Diana13jupiter

How many centuries of Robber Barron leadership do we need to figure out the ‘representative’ Government system, is NOT representing any of us? Nothing I have voted for has come to fruition in the last 5 decades, no matter how many photo opps and speeches that went down. How many decades have we been promised Health Care? Since 1920. Where is it? For example. Who is representing you, right now? Are you being heard? Are your taxes going up or down? Who controls YOUR taxpayer money right now? Do you have any control about what the Representative Government is doing with Trillions of Taxpayer Dollars? No. There’s your Representative Government right there. The 1% take all. For over 200 years. Don’t be afraid of change. It won’t hurt you. We are going to a moneyless system, where we will share the wealth. Why are you afraid of that? Are you afraid of taking control of your community? Of your life?

        • Leatherstocking

“We are going to a moneyless system, where we will share the wealth. Why are you afraid of that? Are you afraid of taking control of your community? Of your life?”

          Holy Schnikies.

          Is this a joke?

I challenge you to outline a system of political/economic mechanisms that deals with:
          1) Preserving Individual Autonomy/Freedom as much as possible
          2) Allocation of Scarce Resources
          3) The Diversity of human value judgements

…better than the idea of Constitutional Government of and by the citizens through elected representatives, and the idea of equally applied Rule of Law.

Have you ever, ever, been in any group of any size, and not had some a$$holes in it?  Do you really think that cheaters, grafters, corruptors and even psychopaths are going to magically disappear?

Your basic notion, is NOWHERE near supported by a vast majority of Americans.  A Moneyless system? Vague “taking control”? Classic Utopian fantasies we all dreamed about in college when we had the luxury of living in our minds and being catered to by the “adult” world of generous educators (working for $).

          You guys are truly frightening.

A monkey could see how our imperfect, but one of the historically best yet system has been corrupted, in large part due to a lack of self-governing vigilance, and our distraction by consumerism and expectations of always having the best the world can possibly offer, and deluding ourselves that we can have a Free Lunch writ large.

That has nothing to do with our self-governing structure or ideals and everything to do with our lack of responsibility in handling the gift of freedom and self government.

You guys really sound like you would be ready to literally steamroll huge numbers of people who disagree that you have found the centuries old Utopian solution, that a vast number of people, while sympathetic to the dream, are much more realistic about life, and historically honest about where such movements of utopian totalitarianism end.

It’s no wonder Congress has the lowest approval rating ever.  Most Americans have lost all faith in the ability of Congress to govern.  And, without serious campaign and financial reform, there is little reason for hope.  Obviously, the 99% are beginning to figure this out.  It may take a 2nd American revolution to bring about serious change in this country.

I’m a securities government investigations attorney in NYC and was frantic to call on-air to add my comments that your two authors are not going far enough with respect to their responses to the politicians’ (you quoted) reactions - they should stick to the basic theme that they originally suggested, which is really that, “legislators, despite having better access and exponentially higher abuse potential under the reasoning behind Section 10 of the ’34 Act, given the inherent quid pro quo control they have over inside leakers, are not only immune to the criminal code to all other Americans must adhere, they are not even held to the standards the American public demands in sports [I did love that analogy by one of your interviewed authors]” — BUT — why I wanted to call:
In response to the outrageously inept responses by the politicians you discusse, the easy amunition bolstering the above theme is that, based on their quoted responses, each such politician would face much WORSE scutiny/culpability in a government/quasi-gov’t (DOj, SEC, NASD) investigation than what the companies/funds/individuals I’ve represented would face if I ever allowed them to utter such responses.  You quoted (but I’m paraphrasing) the ‘pols’ saying things like, “I have never taken into account any information from lobbying entities in my trades,” or “I had no idea”  — these practically provide an evidentiary presumption against their veracity once the gov’t entity can show – 1) communication with the insider; and 2) a trade reasonably close in time thereto beneficially consistent with the information allegedly communciated — PERIOD – Any American citizen or entity is guilty of insider trading and sentenced to prison for the same.  The authors you had on should make that point and, to the extent they challenge another ‘pol’ at a press conference, they just simply force their theme w/ the following - “Congresswomen Pelosi, if you did not have the position of power we voted you into you would be going to jail right now. So just say you did it because it’s not a crime FOR YOU ok? Since that is your only defense.”      Anyway – couldn’t make my last point there because for your radio program NPR is only providing a generic all-Boston Univ # for hopeful callers to go “on air” [?????????????????????????????]

    • JustSayin

Yes, the system is broken but correcting it confounds  both the right and the left.

It’s unfortunate the solution many people have is to throw the bums out next election – and not to persistently pressure Congress to change the rules under which they operate.

Money is a complete abstraction.  If you have tremendous amounts you still need to brush your teeth so what if it is a $5 or 25 cent toothbrush.

Utility does not get get a fair shake these days. with things like planned obsolesence to make more money.  I know that I will be drowned out by all the pat comments we see all the time [but] we have to look at things in a way that makes the 1%’s money meaningless.

Why must we continue to consume more and more to make this economy stronger?  That is such an overwhelmingly fools’s (plural populace) errand.  Why must we have 2 incomes per household?  Our rental bases escalate in such pervasive ways it is sickening like having to have 2 cars as a rental expense to get each worker to work.

I’ve pondered a tabula rasa. There is a side
of this nation I call ScAmerica, that consumes more of the character every day.
Moral hazards & distortions abound.  Besides the problems with the

as education & medicine, as well as the variety of so-called non-profit
& supposed charitable organizations … even religion is blatantly corrupt
& rife with deviancy, while that is not news people still tithe the
charlatans. Did you hear about the outrageous acts of The Crystal Cathedral
organization & the Shuller clan? Since vice, corporateering ideology,
immorality, & dubious ethical relationships have become more influential
(if not commonly typical) then the indulgence, exceptionalism, & disregard
will be accompanied by dysfunction, upheaval, deterioration, & disparity.
It’s absurd & even tragic that ostentatious behavior is indulged; while the
commendable people prefer to donate all that they have or distribute help to
others & their community past the point where it affects their own
livelihood. Although their values provide meaningful examples &
encouragement, their values also influence their personal choice to live
practical & frugal lifestyles as well as maintain critical faculties that
are independent.  Even rule of law is abused to provide subsidies of
various sorts & disable protections, as well as promote moral hazards,
while exceptional indulgences allow evasion of just contributions into the
public revenue, injustice, & disparity. Sure, markets are also distorted as
well as unstable particularly for commodities, necessities, & even for life
essential services.  It’s exploitation & profiting from others
suffering or injury. There is much conflict & hypocrisy but a great deal of
denial as well. As you indicate about the unrealistic idea of sustained growth
or any other sort, it is hubris that others refuse to admit they are wrong
& greedy much less go to any lengths to make adjustments much less
redistribute property (another matter of contest) or bear the sacrifices of
austerity. It is truly outrageous how people have indulged themselves, their
cronies, or other preferred affiliates (relatives, political contributors, …)
with exceptions, inordinate compensation, unrealistic pension benefits, &
failed to pursue prosecution for audaciously crimes much less obtained just
compensation while pushing off their debts, operating expenses, & speculative
risks in order to burden others as if they were indentured servants or implicit
slaves without any voice in the matter, representation, remedy, or opportunity.
There are people that must face the problems & dysfunctional conditions, as
well as their own contributions, while taking action to resolve socio-economic
disparity & injustice. We must show disdain for the hypocrisy exhibited by
the deluded people & not condone propaganda or rhetoric; these violations
must be detected & addressed with appropriate responses communicated
directly to the perpetrators in order to present clear insight to the unjust
conditions, causes, & effects so that they understand that their unjust acts
& disparate policies are unacceptable & intolerable. We also must present
particular proposals along with implementing the absolute level of actions to
resolve such matters of grievance, injury, & undeserved hardship. Time has
past for spin & illusion, time is right for justice & resolution.

Merely showing that scum and effluent keeps rising to the top in ScAmerica.  Recall the global response when GWB received a second term, announced on the The Daily Mirror cover?  One of the clearest cues that prestige was in decline.  Our nation must and can do much better.

    A Lifetime of
Political Honesty Finally Pays Off for Ron Paul

As members of the U.S. Congress are allowed by law to inside
trade, engage in conflicts of interest, leave office and then use their access
to legislators to work for corporations as lobbyists making obscene amounts of
money buying off legislators who are part of the greatest political body money
can buy, Ron Paul’s paltry $2.3 million in personal wealth made from delivering
over four thousand babies, investing in gold and writing best selling books on
economics, banking, foreign policy and liberty shows he has not sold his soul
or the American peoples’ future for his own personal enrichment.  Meanwhile, Newt has accepted over a hundred
million dollars as a lobbyist using this money paid by corporations to buy influence.

As Newt became fattened up by eating on dime of lobbyists
and making millions in contributions while Speaker of the House until he was
hit with dozens upon dozens of ethics violations in which he was fined an unprecedented
$300,000, Ron Paul has remained the leanest politician in Washington and one
whom lobbyists don’t even try to take out for lunch.

Ron Paul will not be getting any major corporate
endorsements anytime soon as he has hit hard at corporate welfare, government
bailouts to banking and a secret and unaccountable Federal Reserve that
literally prints out multiples of trillions of dollars to give to foreign banks
to prop up a collapsing and unsustainable global banking system.  He does this to protect the interests of
Americans and has done so for over thirty years.

One need only to Google “Ron Paul Debates Partee” to see a
much younger Paul flaying the Federal Reserve in a debate that was biblical in
is prophetic pronouncements.  He was the
only politician shredding “the Maestro” Greenspan when everyone believed
Greenspan’s pronouncements about figuring out how to make a debt-based monetary
system behave as if it were still a gold-based system.

One thing you will not hear during this election is any
other candidate bringing to question Dr. Paul’s integrity.   There will be no comments about him
divorcing multiple wives.  There will be
no discussion about his flip-flopping on issues.  There will be no legislation exposed in which he betrayed the U.S.
Constitution or the peoples’ liberty.  There
will be no stories about him receiving millions from corporate donors as the
majority of his money comes from small donations of hundreds of thousands of patriots.  He is prone to brag about one thing.  He is proud of the fact that he has received
more donations from military service members than all the GOP candidates and Obama
combined.  How can any candidate deny
that soldiers support his message of anti-interventionism?

Ron Paul has been as frugal in utilizing his campaign funds as
he has been with taxpayers’ dollars.  He
uses commercial transportation and often flies business class.  However, there is one thing Ron Paul is
guilty of selling.  He has sold the
ideas of peace liberty, personal property and prosperity asking only that
people provide their payment in time –the time needed to educate themselves by
listening to the greatest thinkers, philosophers, economists and statesmen who
have argued on Ron Paul’s side of the issues.
Ron Paul has asked people to consider that money needs to once again
become a product of the market and not the invention of governments that print
oceans of enslaving debt out of nothing but ink and paper.

While Washington politicians do what serves their personal interests
and the interests of state power, Ron Paul has remained steadfast in fighting
for individual freedom and the arguments for his positions are directly attributable
to such thinkers as Ludwig Von Mises, Murry Rothbard, Hans Hermann Hoppe, Carl
Menger, Frederic Bastiat, John Locke, Thomas Jefferson, Alexis de Tocqueville and Etienne de La Boétie.
While the other candidates could not tell you who most of these geniuses
are, Ron Paul could tell you their history, their philosophy and explain how each
    came to their intellectual conclusions.

This election will be the one that has
the last chance of again binding government to the Constitution and ensuring
    liberty.  Before voting please consider
which candidate’s personal history exemplifies fidelity to the ideas upon which
    this nation was originally founded.
